Boat Owner Agreement: (instructional delivery)

This document outlines an agreement between ­­­­­­___________, owner of the (model/make/name ­­­­­­ ___________ ___________ “___________,” and Bluewater Miles LLC. 

Bluewater Miles will supply a qualified captain and crew, a total of at least 2 people, to deliver “___________” from ­­­­­­___________to ­­­­­­___________.  The intended departure date is ­­­­­­___________, however, this date may be adjusted slightly at the captain’s discretion depending on weather, equipment or other timing issues.  Arrival should occur sometime around  ­­­­­­___________, depending on a variety of possible influences, such as weather and equipment issues.

The owner is responsible for the seaworthiness of the boat, boat documentation and safety gear on board, as well as all boat-related expenses, such as equipment repairs, equipment failure, boat damage, marina fees and refueling.  The Bluewater Miles captain will operate the vessel in a professional manner, with crew safety as his first priority.  Upon arrival at the boat, the captain will inspect boat and gear, and may delay or cancel the delivery if he or she considers the boat unsafe or unseaworthy.  The captain and Bluewater Miles will work with the owner to try to remedy such situations whenever possible.  Any additional costs related to such unforeseen preparations will be discussed ahead of time, and may be billed to the owner.  If the delivery must be cancelled, the delivery deposit, less expenses, will be reimbursed.

In exchange for this delivery, the owner agrees to pay $2.50 per nautical mile, or $_____, plus boat expenses. Captain and crew expenses will be arranged by Bluewater Miles.

Bluewater Miles will endeavor to sign up as many as 5 crew total, including captain, but will sail with as few as 2—captain plus 1.  Any minimum crew requirements requested by the owner beyond 2 may result in additional owner expenses, including but not limited to hired-crew pay, provisions and travel expenses.  Bluewater Miles will try its best to keep such expenses to a minimum and find crew that pay their own way whenever possible.

Bluewater Miles requires a deposit from the owner of $1.50 per nautical mile, or $1500, as commitment to the agreed delivery dates.  Dates, as well as the delivery itself, are not fixed until the deposit is received.  Deposits should be made at least a month before departure.  The balance will be billed to the owner shortly after vessel delivery. 

Everyone involved, including owner, Bluewater Miles, captain and crew, recognize and accept that sailing involves risks.  Everyone involved will do their best to make sure the delivery is performed safely, however, everyone must acknowledge that equipment failure, weather issues, and health issues can affect the delivery in unforeseen ways.  Everyone involved agrees work together to resolve any issues that may arise.
